Key facts about redundancy
- · Individual consultation is compulsory regardless of the circumstances. This must be meaningful and should be documented.
- · Employees with 2+ years of service can take reasonable paid time off to look for new work or arrange training during their notice period.
- · Employees with 2+ years of service will qualify for Statutory Redundancy Pay (SRP) which the employer must pay.
- · Whilst SRP can be paid tax free up to the £30,000 threshold, other payments such as notice pay and holiday pay must be subjected to statutory deductions. If you roll these amounts into a tax free (ex-gratia) payment not only do you risk sanctions from HMRC but you could also be exposed to claims from the ex-employee that these were not paid.
- · If you have an employee on maternity whose role is at risk of redundancy they must be offered another suitable role if one is available. They should not be required to interview for it.
